Pikpup Terms of Service

Introduction

Welcome to Pikpup! These Terms of Service (“Terms”) are a legal agreement between you and Pikpup (“we,” “us,” or “our”) governing your use of the Pikpup mobile application and related services (“Pikpup App” or “Service”). By downloading, accessing, or using Pikpup, you agree to these Terms. If you do not agree, please do not use the Service. These Terms apply in addition to any terms and policies of the app store from which you downloaded the Pikpup App (e.g. Apple App Store or Google Play). You acknowledge that the app store provider (Apple, Google, etc.) is not a party to these Terms and not responsible for the Pikpup App, its content, or maintenance. Pikpup is solely responsible for the app and its content. The app store providers and their subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you.We may update these Terms from time to time. If we make changes, we will provide notice by updating the “Last Updated” date above and/or via an in-app notification. Continued use of Pikpup after changes means you accept the revised Terms.

Eligibility (Age Restrictions)

You must be at least 14 years old to use Pikpup. The Service is not intended for individuals under 14. By creating an account or using Pikpup, you confirm that you are 14 or older. If you are under 18, you should review these Terms (and our Privacy Policy) with a parent or guardian to ensure you understand them. We reserve the right to terminate or suspend your account if we have reason to believe you are under 14 years old. Pikpup is intended for personal use; business or commercial use may require separate permission.

Account Registration and Management

Account Creation: To access most Pikpup features, you must create an account with a valid email, a secure password, and accurate profile information (such as your name, contact information, and pet details). You agree to provide truthful, current information and to update it if it changes. Each user may maintain only one account, and it is non-transferable.Account Security: You are responsible for maintaining the confidentiality of your login credentials. Do not share your password or allow others to access your account. You are responsible for all activity that occurs under your account. If you suspect any unauthorized use of your account, notify us immediately. We will assume any activity under your login is yours or authorized by you, and you may be held liable for losses caused by failing to secure your. Pikpup is not liable for any loss or damage arising from unauthorized use of your account due to your failure to safeguard your .Account Termination: You may delete your account at any time via the app or by contacting support. We reserve the right to suspend or terminate your account (with or without notice) if you violate these Terms, violate applicable law, or engage in prohibited conduct. If your account is terminated (by you or us), you may lose access to your profile, content, or any data associated with the. We are not responsible for retaining or providing you with data from a closed account, except as required by law.

User Responsibilities and Conduct

By using Pikpup, you agree to use the Service responsibly and only for its intended purpose of connecting pet owners with pet care providers. You agree that you will not:

Misrepresent yourself or provide false information in your profile or communications. Use only your own identity and do not impersonate any person or entity.Use the Service for any unlawful, fraudulent, or harmful purpose. This includes complying with all animal welfare laws, pet licensing requirements, and other regulations in your or transmit any content that is illegal, offensive, defamatory, obscene, harassing, or that violates any third party rights. This includes refraining from hate speech, harassment of other users, or content that would be harmful to others or to animals.Attempt to scrape, hack, reverse-engineer, or compromise the Pikpup App or our systems. You agree not to interfere with the normal operation of the Service, not to introduce any malicious code, and not to circumvent any security measures.Solicit other users for services outside of Pikpup or engage in any activity that circumvents our platform or fees. All bookings and payments for pet care services arranged through Pikpup should be completed through the app for the safety and accountability of all parties.

User Content: If you upload or provide any content (such as pet photos, profiles, reviews, or messages), you grant Pikpup a license to use, display, and share that content as needed to operate the Service. You are solely responsible for any content you provide and for ensuring it does not violate any laws or rights of others. We do not routinely monitor user content, but we reserve the right to review, remove, or moderate content that violates these Terms or our policies.Communications: Be respectful and courteous in your interactions with pet owners, pet sitters, and any Pikpup staff. You are responsible for your communications and agree not to spam, stalk, or abuse other users. Any issues or disputes with other users should be handled professionally and, if needed, reported to Pikpup for review.

Pet Care Services Platform (Marketplace Terms)

Pikpup is a platform that connects pet owners with pet care providers (such as pet sitters, walkers, etc.). Pikpup itself does not provide pet care services. Pet care providers (“Service Providers”) listed on Pikpup are independent contractors and are not employees, agents, or representatives of Pikpup. Pikpup does not supervise the pet care services and makes no guarantees about the quality, safety, suitability, or reliability of any pet care provider or service. Any arrangement or contract for pet care is strictly between the pet owner and the Service Provider.While we may conduct basic screenings or verifications on service providers (for example, identity checks or reviews), Pikpup does not guarantee the completeness or accuracy of any background check or profile information. Users should exercise their own judgment and take appropriate precautions when engaging a pet sitter or meeting another user. For example, pet owners are responsible for ensuring their pets are healthy and have up-to-date vaccinations, and service providers are responsible for providing care in a safe, professional manner. Your use of the Service to find pet care is at your own risk, and you acknowledge that any harm, injury, or loss that occurs during pet care services is a matter between the users involved.Pikpup is not responsible or liable for the actions or omissions of any pet owner or pet care provider you meet through our platform. This includes any injury to persons, pets, or property that may result from pet care arrangements. We strongly encourage users to clearly communicate expectations, pet needs, and emergency plans with each other before a booking, and to have their own insurance or contingency plans as needed. Pikpup may offer support or mediation in the event of a conflict, but we do not systematically provide insurance or guarantees for pet care (unless explicitly stated in a separate Pikpup policy).All transactions and bookings made through Pikpup are solely between the pet owner and the service provider. Pikpup’s role is limited to providing the platform and facilitating payments. Except as provided under any specific refund or guarantee policy we may introduce, Pikpup will not be liable for any cost or damages arising from agreements between users, including but not limited to veterinary costs, injuries, or property damage. You assume full responsibility for the outcomes of using our Service to arrange pet care.

Payments and Fees

Using Pikpup to book pet care services may involve payments. Users must have a valid payment method on file to book services. Pet owners agree to pay the fees indicated for the services they book, and service providers agree that Pikpup may collect payments on their behalf. All fees and charges will be disclosed before you confirm a booking.Third-Party Payment Processor: Payments on Pikpup are processed by a third-party payment processor. We use Stripe as our payment provider. This means when you enter your payment details, that information is sent securely to Stripe. We do not store your full credit card information on Pikpup’s servers. Payment processing is subject to Stripe’s own Terms of Service and Privacy Policy, and by making a payment you agree to comply with those terms. Pikpup is not responsible for the performance or security of the Stripe services, though we carefully chose Stripe as a reputable payment processor.When you make a purchase or booking, you authorize us to charge your provided payment method through the payment processor for the total amount (including any applicable taxes or fees). If there are any issues processing payment, we may suspend or cancel the booking. You are responsible for any charges or fees resulting from failed payments (e.g., overdraft fees or currency exchange fees).Service providers on Pikpup authorize Pikpup to collect payments from pet owners on their behalf and understand that payouts will be processed via Stripe to the bank account information they provide. Providers are responsible for any taxes on their earnings as required by law.Cancellation and Refunds: Cancellation policies may apply to bookings (e.g., a deadline to cancel for a full refund). These policies will be communicated during booking. Pet owners and providers agree to honor the applicable cancellation and refund terms for each booking. Pikpup may, at its discretion, assist in resolving refund disputes, but any ultimate agreement on refunds is between the pet owner and provider, unless otherwise stated in a Pikpup policy.

Third-Party Services and Links

The Pikpup App may contain links to third-party websites or services, or integrate third-party features (such as maps, communication tools, or social media sharing). These are provided for convenience. Pikpup does not endorse or control third-party services and is not responsible for their content, policies, or performance. If you access third-party links or services through Pikpup, you do so at your own risk and must adhere to their separate terms and policies. For example, if Pikpup integrates map services for showing pet sitter locations, any use of those map features may be subject to Google Maps or Apple Maps terms, and we are not liable for inaccuracies in map data or any issues arising from their use.

License Grant and Intellectual Property

Subject to your compliance with these Terms, Pikpup grants you a limited, non-exclusive, non-transferable, revocable license to download and use the Pikpup App on your personal device solely for the purposes of accessing the Service. You may not copy, modify, distribute, sell, or lease any part of our app or services, nor may you reverse engineer or attempt to extract the source code of the software, except as permitted by law. Pikpup retains all rights, title, and interest in and to the Pikpup App, website, logos, trademarks, and content (excluding user-provided content). You agree not to use our intellectual property without our prior written consent.Any feedback or suggestions you provide to Pikpup about the Service is entirely voluntary, and we are free to use such feedback as we see fit and without any obligation to you.

Legal Compliance

You agree to use Pikpup in compliance with all applicable laws and regulations. It is your responsibility to ensure that your use of the Service is legal in your jurisdiction. This includes, but is not limited to, abiding by local laws regarding pet care services, data privacy, and online conduct. If you are a pet care provider, you are solely responsible for complying with any legal requirements for offering pet services (for example, business licenses, permits, or insurance if required in your area).By accessing or using the Service, you represent and warrant that (a) you are not located in a country that is subject to a U.S. government embargo or designated as a “terrorist-supporting” country, and (b) you are not listed on any U.S. government list of prohibited or restricted. This assures us that providing you access to Pikpup does not violate export control or sanctions laws.If applicable laws require that certain information about a pet (such as vaccination status or breed restrictions) be disclosed or certain protocols followed, it is the users’ responsibility to adhere to those laws. Pikpup will cooperate with lawful requests from law enforcement or regulatory authorities (e.g., responding to court orders or subpoenas) and may report content or behavior that appears to violate laws (for example, animal abuse, fraud, or other illegal activities) as we deem appropriate.

Liability Disclaimer

Use at Your Own Risk: Pikpup strives to provide a safe and reliable platform, but the Service is provided “as is” and “as available.” You use Pikpup at your own risk. To the fullest extent permitted by law, we disclaim all warranties, express or implied, regarding the Service, including any warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties that the Service will meet your requirements or be available uninterrupted, secure, or error-free. We do not guarantee the accuracy or reliability of any information obtained through the Service (including user profiles, ratings, or reviews).No Liability for Conduct of Others: Because Pikpup is a marketplace platform, you acknowledge that we cannot be held responsible for the acts or omissions of other users (pet owners or pet sitters). Pikpup has no liability for any claims, injuries, losses, or damages whatsoever arising from or in connection with your interactions with other users (whether online or offline) or the pet care services provided. This includes, without limitation, any harm to you, your pet, or your property, or any dispute between you and another user. Your provision or use of pet care services arranged through Pikpup is at your sole risk.Limitation of Liability: To the maximum extent permitted by law, in no event shall Pikpup (or its officers, directors, employees, or agents) be liable to you for any indirect, incidental, consequential, special, or punitive damages, or any loss of profits, data, use, or goodwill, arising out of or related to your use of (or inability to use) Pikpup or any pet care services arranged through Pikpup. In no event will Pikpup’s total cumulative liability exceed the amounts you have paid to Pikpup in the twelve (12) months prior to the claim, or one hundred US dollars (USD $100), whichever is greater. Some jurisdictions do not allow certain limitations, so some of these exclusions or limits may not apply to you to the extent disallowed by Warranty: Pikpup does not warrant that the app will be error-free or that any pet care services will meet your expectations. While we hope every pet sitter and pet owner has a great experience, we make no promises or guarantees about any specific outcome from using the platform. Any advice or information (oral or written) obtained from Pikpup or through the Service does not create any warranty not expressly stated in these Terms.Indemnification: You agree to indemnify, defend, and hold harmless Pikpup and its affiliates, officers, agents, and employees from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with: (a) your use of the Service or any services obtained through the Service, (b) your violation of these Terms or of any applicable law or regulation, or (c) your infringement of any rights of any third party (including other users) in the course of using the Service. We reserve the right to handle our legal defense as we see fit, including choosing our counsel, and you agree to cooperate with us in the event of any claim.

Modifications and Termination of Service

Pikpup reserves the right to modify, suspend, or discontinue the Service (or any features within the Service) at any time, for any reason, and without advance notice. We are not liable to you if any part of the Service is changed or terminated. We may, for example, introduce new features or impose limits on certain features, or we might stop supporting a particular device or platform.If we discontinue the Service or a critical feature, we will attempt to give users reasonable notice to retrieve any important data. However, it is ultimately your responsibility to keep backups of any information (such as pet or client information, communications, etc.) that you may need. Continuing to use the Service after modifications to it or to these Terms signifies your acceptance of those changes.

Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the jurisdiction where Pikpup is headquartered (without regard to its conflict of law principles). This means that the laws of Florida will govern any dispute arising between you and Pikpup related to the Service or these Terms.In the event of any dispute or claim between us, we encourage you to contact Pikpup support to seek an informal resolution first. If we cannot resolve the issue informally, any legal action shall be brought in the courts of the competent jurisdiction in Florida, and you agree to submit to the personal jurisdiction of such courts.Consumers: If you are using Pikpup for personal, non-commercial purposes, certain consumer protection laws of your country of residence may apply. These Terms are not intended to limit your rights under those laws where applicable.Arbitration (if applicable): At our sole discretion, we may require any dispute between us to be resolved through binding arbitration, rather than in court, to expedite resolution. If so, we will provide a separate arbitration agreement or clause detailing the process, which will comply with relevant laws and allow you to opt-out within a certain time after first agreeing to these Terms.

Severability

If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, that provision will be enforced to the maximum extent permissible and the remaining provisions of these Terms will remain in full force and effect. Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.
